TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale (the "Terms") outline the agreement between Bathroom & Fireplace Warehouse Ltd ("we," "us," or "our") and you, the customer ("you" or "customer"), regarding the purchase of Goods and services from us. By making a purchase with us, you agree to abide by these Terms.
By making a purchase from Bathroom & Fireplace Warehouse Ltd, you acknowledge that you have read, understood, and agreed to these Terms of Sale. These terms are subject to change without notice, and the version in effect at the time of your purchase will apply.
Please read through these Terms and Conditions carefully before placing an order with us.
DESCRIPTION & QUALITY
1.1 We strive to provide accurate and up-to-date information about our Goods. However, specifications, availability, and pricing may change without notice. It is your responsibility to verify the Goods details before making a purchase.
1.2 The description of Goods as set out in our website, brochures or other form of advertisement is for illustrative purposes only and there may be small discrepancies in colour or size.
1.3 The description of Goods are subject to alteration without notice.
1.4 In agreeing to sell Goods to you, we make no guarantee as to the suitability of those Goods to the specific installation you have in mind and give no warranty that the Goods can be used in any given environment.
PRICING & PAYMENT
2.1 All Goods will be charged at prices current at the time of purchase (inclusive of VAT at the current rate).
2.2 Prices displayed in our Showroom are subject to change without notice. We make every effort to ensure pricing accuracy, but errors may occur. In case of a pricing error, we reserve the right to withdraw the item from sale.
2.3 Any quotation is valid for a maximum period of 14 days from its date, unless we expressly withdraw it at an earlier time.
2.4 The price of Goods does not include delivery charges. Our delivery charges will be advised to you during the ordering process.
2.5 Goods that have been ordered using a deposit shall not be released or made available for collection until the remaining balance is paid in full. We shall hold any Goods ordered which you cannot accept for any reason for 14 days, after which time the Goods must be paid for in full. All Special Order Goods must be paid for in full at the time of ordering.
2.6 We accept payments from most credit and debit cards. We also accept payments in cash, BACS or Building Society cheque made payable to Bathroom & Fireplace Warehouse Ltd. Personal or Company cheques must be submitted and cleared before Goods will be released. Payment for Goods and delivery must be made in full at the point of order. All transactions will be in pounds sterling.
ORDERS & CANCELLATIONS
3.1 In the case of Goods made to your special requirements, it is your responsibility to ensure that any information you provide is accurate.
3.2 You are unable to amend an order once it has been placed. If you need to cancel your order, please contact a member of our team as soon as possible.
3.3 If you cancel an order after it has been dispatched by our supplier then you bear the responsibility of returning Goods at your own expense and risk. You may be charged a Re-stocking Fee.
3.4 You are unable to cancel at any stage if you have purchased any Special Order or Made to Measure Goods.
3.5 Bathroom & Fireplace Warehouse Ltd reserve the right to charge a cancellation or handling fee for any Goods cancelled or returned.
DELIVERY & COLLECTION
4.1 Deliveries can only be made to the address that was given at the time of purchase.
4.2 If your order contains items with different delivery lead times, the longest delivery lead time will usually apply to the entire order. If you would prefer multiple deliveries, extra fees will be incurred.
4.3 Goods are ordered from our suppliers and stock levels may be affected by reasons beyond our control. Occasionally, this may lead to a delay in the availability and delivery of Goods ordered. In such circumstances we will notify you as soon as possible but we cannot be held responsible for the delay of your order.
4.4 All large deliveries are kerbside only. Our delivery drivers are not insured to enter a private residence so we suggest you have someone to assist you.
4.5 Under no circumstances will Goods be dropped off on private property, such as drive ways or gardens and it is your responsibility to move Goods to their final destination once delivered.
4.6 We cannot deliver up/down steps, to grassed lawns, narrow lanes, steep or gravelled drives or across otherwise uneven terrain.
4.7 You must notify us about any obstacles at your chosen address which may affect delivery, such as any parking and/or unloading restrictions at your chosen address, including red and yellow lines. We reserve the right to recover from you, and you agree to be responsible for, any costs incurred on delivery, such as fines incurred for parking and/or unloading in restricted areas.
4.8 Although we try our best to meet our quoted delivery dates/times, they are only estimates and we will not be held responsible if we cannot do so.
4.9 We cannot be held responsible for any third party costs or charges incurred by you because your Goods did not arrive on time or if your Goods were not checked immediately upon delivery. As such, we strongly advise that you do not book any tradespeople, fitters nor engage in preparatory work until full receipt and inspection of Goods.
4.10 All deliveries received must be signed for by a person over the age of 18. If no one suitable is available to receive the delivery or no one is home, then you are liable for any additional charges for re-delivery.
4.11 Once we have delivered your Goods or have made the first attempt to deliver your Goods to you, any risk of damage or loss will pass to you.
4.12 If you would prefer to collect your Goods in person, please contact us to discuss. Our staff are able to assist with transporting heavy Goods from the showroom to your vehicle only if it is safe to do so.
4.13 If you arrange to collect Goods from our premises, either in person or via a third-party carrier, the risk in the Goods will pass to you on collection. We will not be liable for any damage or breakages incurred while the Goods are in transit after collection.
EXAMINATION & ACCEPTANCE
5.1 Once you have received and signed for your Goods, please do not store them away for later inspection. You must thoroughly check the Goods so that, in the unlikely event that there is any visible damage, missing item or incorrect part, we can contact the supplier to resolve any issues.
5.2 You must report any damage, missing item or incorrect part to us within 48 hours of receipt by phone or email. We cannot be held responsible for any damage, missing item or incorrect part that is not reported to us within 48 hours.
5.3 We are not responsible for any Goods received or unpacked by anyone other than the customer, so please ensure that person is present to check and sign for the Goods at the supplied delivery address.
5.4 Goods are deemed to have been accepted once you have commenced installation.
5.5 Goods that have been used, installed or made-to-order will not be accepted as damaged items.
5.6 We reserve the right to recover any associated costs from you if we do not agree that Goods are defective or if any defect is deemed to be through fault of your own and to reject any claim in respect of alleged damages or defective Goods. In these circumstances, you will be expected to bear the cost of collection and/ or redelivery and/or replacement Goods.
RETURNS & REFUNDS
6.1 We do not offer returns or refunds on Goods that are in perfect working condition due to customer error or a change of mind.
6.2 We cannot accept returns from someone other than the customer who purchased the Goods.
6.3 To be eligible for a return or credit, Goods must be unused, in the same condition that you received them, in the original packaging and fit for resale. If the Goods are found to be damaged, used or imperfect, charges will apply.
6.4 To complete your return, we require proof of purchase.
6.5 Only regular priced Goods may be refunded. ‘Sold as see Goods’ cannot be refunded.
6.6 No refunds or exchanges can be given on Special Order or Made to Measure Goods unless they are faulty or not as described.
6.7 We only replace or refund the cost of Goods where:

The Goods supplied do not correspond to any written identifying description applied to them.

The Goods are unfit for a particular purpose which has been expressed in writing by Bathroom & Fireplace Warehouse Ltd.
6.8 Bathroom & Fireplace Warehouse Ltd reserve the right to charge a reasonable handling fee for any Goods which we have agreed can be replaced or refunded.
WARRANTIES
7.1 Goods sold by Bathroom & Fireplace Warehouse Ltd come with warranties provided by the manufacturer. These warranties are subject to the Terms and Conditions set by the manufacturer. We will assist you in handling warranty claims to the best of our ability.
LIABILITY
8.1 We are not responsible for any indirect, consequential, or incidental damages arising from the use of Goods bought from us.
8.2 We will not be liable to you for lost working time or the cost of third party contractors, or any other consequential loss, where you (or your contractor) fail to install the Goods correctly.
8.3 Our liability is limited to the purchase price of the Goods you have bought from us.
8.4 We will not be liable or responsible for any failure to meet or delay in meeting any of our obligations under a Contract that is caused by events outside our reasonable control including: Acts of God, fire, flood, severe weather, explosion, war, act of terrorism, industrial dispute (whether or not involving Bathroom & Fireplace Warehouse Ltd employees), or acts of local or central Government. This does not affect your statutory rights.
GOVERNING LAW
These Terms and Conditions of Sale are governed by and construed in accordance with English Law. The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England. All contracts are concluded in English.
